1. Service Description and Critical Limitations

PetMed is an online platform that provides educational information and triage guidance to help pet owners make informed decisions about their pet's health. Our services include:

• AI-powered symptom assessment tools
• Educational content about pet health conditions
• Triage guidance to help determine urgency of veterinary care
• General wellness information

CRITICAL LIMITATION: PetMed does NOT provide veterinary medical services, diagnosis, treatment, prescriptions, or establish a Veterinarian-Client-Patient Relationship (VCPR). Our service is designed to complement, not replace, professional veterinary care.

2. No Veterinarian-Client-Patient Relationship (VCPR)

By using PetMed's services, you acknowledge and agree that:

• No VCPR is established: Use of this service does not create a veterinarian-client-patient relationship between you, your pet, and PetMed or any veterinarians who may review content on our platform.
• Not a substitute for veterinary care: Information provided through PetMed cannot replace the professional judgment of a licensed veterinarian who has physically examined your pet and has access to your pet's complete medical history.
• No prescriptions: We cannot and will not prescribe medications, provide treatment plans, or authorize veterinary procedures.
• Educational purpose only: All information provided is for educational and informational purposes to help you make informed decisions about seeking appropriate veterinary care.

3. Not Veterinary Medical Advice

The information, recommendations, and assessments provided by PetMed:

• Are generated by AI algorithms based on the information you provide
• Are intended for educational and triage purposes only
• Should not be considered or relied upon as veterinary medical advice, diagnosis, or treatment recommendations
• May not account for all relevant factors affecting your pet's health
• Cannot replace the expertise of a licensed veterinarian who has physically examined your pet

You should always consult with a licensed veterinarian before making any decisions about your pet's health, treatment, or care based on information obtained through PetMed.

4. Emergency Situations

Emergency situations may include, but are not limited to:

• Difficulty breathing or choking
• Severe bleeding or trauma
• Loss of consciousness or seizures
• Suspected poisoning or toxin ingestion
• Severe pain or distress
• Inability to urinate or defecate
• Sudden collapse or inability to stand

PetMed is not designed for, and should never be used in, emergency situations. Always prioritize immediate veterinary care in emergencies.

5. Pet Profile and Data Usage

By creating pet profiles and providing information about symptoms, health history, and other relevant data, you:

• Agree to the collection and use of this information to provide educational and triage guidance
• Represent that you have the legal right to provide this information
• Understand that the accuracy of any guidance depends on the completeness and accuracy of the information you provide
• Acknowledge that our AI tools will process this data to generate educational content and triage assessments

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• PetMed, its officers, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to your use of our services
• This includes, but is not limited to, damages related to:

  • Decisions made based on our educational content or triage guidance
  • Delays in seeking veterinary care
  • Any harm to your pet's health or well-being

By using PetMed, you acknowledge that you are solely responsible for decisions regarding your pet's health and veterinary care.

• We make no warranties or guarantees about the accuracy, completeness, or reliability of any information provided
• Medical knowledge and veterinary practices evolve, and information may become outdated
• AI-generated assessments may contain errors or omissions

You may use our services in accordance with these Terms and all applicable laws and regulations. You agree not to misuse our services, and you acknowledge that you will not:

• Use the services for any unlawful purpose or in violation of any laws
• Attempt to gain unauthorized access to any part of our platform
• Interfere with the proper functioning of our services or disrupt our systems
• Use the service as a substitute for professional veterinary care
• Rely solely on PetMed's information for medical decisions without consulting a veterinarian
• Use the service in emergency situations

10. Account Responsibilities

You are responsible for maintaining the confidentiality of your account information, including your password. You agree to:

• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use or security breaches related to your account
• Provide accurate and truthful information when creating pet profiles
• Keep your account information current and up to date

11. Intellectual Property

All content on PetMed's platform, including but not limited to text, software, graphics, logos, AI algorithms, and educational materials, is the property of PetMed and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works based on our content without written permission from PetMed.

12. Prohibited Activities

You may only access or use PetMed's services for their intended purposes as outlined in these Terms. Our services are not to be used for any commercial activities unless explicitly approved by PetMed.

As a user of PetMed's services, you agree to refrain from:

• Systematically collecting or harvesting data or content from the services without our express written consent
• Engaging in any deceptive activity, including attempting to obtain sensitive information through fraud or misrepresentation
• Bypassing, disabling, or tampering with security features
• Using information obtained from our services to harass, harm, or abuse others
• Misusing our support channels or submitting false reports
• Using the services in violation of any applicable laws or regulations
• Uploading or transmitting malicious content, such as viruses or harmful code
• Engaging in automated or scripted activities such as using data extraction tools

These Terms and Conditions will remain in full effect while you use PetMed's services. We reserve the right, at our sole discretion and without prior notice or liability, to restrict or block access to the services to any individual for any reason, including but not limited to:

• Breaches of these Terms and Conditions
• Violations of applicable laws or regulations
• Misuse of our services
• Fraudulent or harmful activity

We may terminate your use of the services or delete your account and any related content at any time. If your account is suspended or terminated, you are prohibited from registering or creating a new account.

14. Modifications to Service and Terms

PetMed reserves the right to:
